Terms of Service
1. Introduction
Welcome to Nowish. These Terms of Service (“Terms”) govern your use of the Nowish platform, website (nowish.in), and mobile application (collectively, the “Platform”). By accessing or using Nowish, you agree to be bound by these Terms.
Nowish is operated by Bite of Health Private Limited, Plot-342, Udhyog Vihar, Phase-6, Sector-37, Gurgaon-122001, Haryana, India (“we”, “us”, “our”).
If you do not agree to these Terms, please do not use the Platform.
2. Definitions
- “Platform” — the Nowish website, mobile application, and all related services
- “Customer” — any individual using the Platform to discover or request deals
- “Business” — any merchant or service provider registered on the Platform
- “Deal” — any offer, discount, promotion, or transaction facilitated through the Platform
- “AI-Generated Deal” — an automated offer created by Nowish's AI system on behalf of a registered business
- “User” — any Customer or Business using the Platform
3. Eligibility
To use Nowish you must:
- Be at least 18 years of age
- Be a resident of India or an authorised representative of a business registered in India
- Have a valid mobile device capable of running the Nowish application
- Agree to these Terms and our Privacy Policy
By using the Platform you represent and warrant that you meet all eligibility requirements.
4. Customer Terms
4.1 Account Registration
You may use Nowish as a guest or by creating a registered account. If you create an account you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
4.2 Deal Requests
When you submit a deal request through the Platform you are making a genuine, good-faith request to purchase a product or service from a nearby business. Submitting false, spam, or abusive deal requests is prohibited.
4.3 Deal Acceptance
When you accept a bid or offer from a business through the Platform you enter into a direct agreement with that business. Nowish is not a party to that transaction. Any disputes regarding the deal, product quality, delivery, or payment are between you and the business directly.
4.4 Location and Notifications
By enabling location and notification permissions you consent to receiving proximity-triggered deal alerts when you are near participating businesses. You may withdraw these permissions at any time in your device settings.
4.5 Prohibited Customer Conduct
You must not:
- Submit false or misleading deal requests
- Abuse, harass, or threaten businesses on the Platform
- Attempt to circumvent the Platform's AI systems
- Use the Platform for any unlawful purpose
- Create multiple accounts to manipulate deal outcomes
- Reverse engineer or copy any part of the Platform
5. Business Terms
5.1 Business Registration
When you register your business on Nowish you confirm that:
- You are the authorised owner or representative of the business
- All information provided is accurate and up to date
- Your business operates lawfully under applicable Indian laws
- You have the right to offer the deals and promotions listed
5.2 AI-Generated Deals
By registering on Nowish you consent to the Platform's AI system automatically generating deals on your behalf when customers are in proximity to your business. You understand that:
- AI-generated deals are created based on your business profile and category
- You may configure, modify, or override AI-generated deals in your business dashboard
- You are responsible for honouring any deal a customer accepts, including AI-generated deals
- Nowish is not responsible for any AI-generated deal that you choose not to honour
5.3 Business Responsibilities
You are solely responsible for:
- The accuracy of your business information on the Platform
- The fulfilment of all deals accepted by customers
- Compliance with all applicable consumer protection laws
- Any taxes, duties, or levies applicable to your transactions
- The quality and delivery of your products or services
5.4 Customer Data
As a business on Nowish you acknowledge that:
- Customer deal interaction data shared with you must be handled in accordance with applicable privacy laws
- You must not use customer data for purposes beyond fulfilling the deal
- You must not sell or share customer data with third parties
- You are responsible for the security of customer data you receive
5.5 Prohibited Business Conduct
You must not:
- List false, misleading, or illegal products or services
- Manipulate deal pricing or availability deceptively
- Discriminate against customers unlawfully
- Use Nowish to collect customer data beyond deal fulfilment
- Spam customers with unsolicited communications
6. Nowish's Role
Nowish is a technology platform and marketplace facilitator. We are not a party to any transaction between customers and businesses. Specifically:
- We do not buy or sell any products or services
- We do not handle payments between customers and businesses
- We do not guarantee the quality, safety, or legality of any deal
- We do not verify the accuracy of business listings beyond the onboarding process
- We are not responsible for disputes between customers and businesses
- We are not liable for any loss arising from a deal transaction
Nowish's role is solely to connect customers and businesses in real time through our AI-powered platform.
7. AI and Automation
The Nowish platform operates through AI automation. You acknowledge and agree that:
- Deal matching, business onboarding, and proximity-triggered notifications are fully automated
- No human at Nowish reviews, approves, or moderates individual deals or transactions in real time
- AI-generated deals are created algorithmically and may not always perfectly reflect a business's current inventory or pricing
- Nowish is not liable for errors or inaccuracies in AI-generated content
- You may report inaccurate AI-generated deals through the Platform
8. Intellectual Property
All technology, systems, methods, designs, content, and innovations on the Nowish Platform are the exclusive intellectual property of Nowish and its founder.
The core technologies powering Nowish are protected under a provisional patent application filed with the Indian Patent Office under the Patents Act, 1970.

You must not:
- Copy, reproduce, or imitate any part of the Platform
- Reverse engineer any technology or system used by Nowish
- Use the Nowish name, logo, or brand without written permission
- Claim ownership of any content or technology belonging to Nowish
9. Disclaimers
9.1 Platform Availability
Nowish is provided on an “as is” and “as available” basis. We do not guarantee uninterrupted, error-free, or secure access to the Platform at all times. We may suspend or discontinue the Platform at any time without notice.
9.2 Deal Accuracy
We do not warrant the accuracy, completeness, or reliability of any deal, offer, or business listing on the Platform. Deals are subject to availability and business confirmation.
9.3 AI Limitations
AI-generated deals and recommendations are automated and may contain errors. We do not warrant that AI-generated content is always accurate, appropriate, or suitable for every user.
10. Limitation of Liability
To the fullest extent permitted by applicable law, Nowish and its founder shall not be liable for:
- Any indirect, incidental, special, or consequential loss or damage
- Loss of profit, revenue, data, or business opportunity
- Any loss arising from a deal transaction between a customer and a business
- Any loss arising from reliance on AI-generated content
- Any loss arising from unauthorised access to your account
- Any loss arising from Platform downtime or technical errors
Our total liability to you for any claim shall not exceed ₹1,000 or the amount you paid to use the Platform, whichever is lower.
11. Indemnification
You agree to indemnify, defend, and hold harmless Nowish and its founder from any claims, losses, damages, liabilities, costs, or expenses (including legal fees) arising from:
- Your use of the Platform
- Your violation of these Terms
- Your violation of any applicable law
- Any dispute between you and another user of the Platform
- Any deal transaction you enter into through the Platform
12. Governing Law and Disputes
These Terms are governed by the laws of India. Any disputes arising from or relating to these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Gurugram, Haryana, India.
We encourage you to contact us at legal@nowish.in before initiating any legal proceedings, so we can attempt to resolve the matter amicably. These Terms are also subject to the Digital Personal Data Protection Act, 2023 of India.
13. Termination
We reserve the right to suspend or terminate your access to the Platform at any time, with or without notice, if we believe you have violated these Terms or applicable law. You may terminate your account at any time by contacting legal@nowish.in.
Upon termination, your right to use the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination shall continue to apply.
14. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the “Last Updated” date at the top of this page and notify registered users by email. Your continued use of the Platform after changes constitutes acceptance of the updated Terms.
